Custodial or not Custodial

At The Time of our seperation. We have shared parenting with no child suport,But at the time my son was living with his father so on the papers he was concidered the custodial parent,but now for the past 3 years my son has lived with me and goes to his fathers for most of the summer.I am wondering if since he has lived with me for 3 years now would i be concidered the custodial parent or do i have to get that changed in court???

just ended 25yr relationship. 18 yr marriage. have 5 boys together. i currently have custody. he has tue,thur,and sat. we made no child support agreement in court . he privately agreed to pay me 250.00 a week to cover the food bill. he works construction and usually makes no less than 20 an hr. he is behind in payments 3 weeks now. he is currently dating another woman who has a child and i feel his money is going toward her instead of our 5 boys. i need to know should i go back yo court,or is him signing an aggreement privately good in court. also we are not legally seperated. can i go after him and his new girl
