Wrested from their hands by whom? Other rich "white men"...such as the ones who passed the 13th amendment abolishing slavery...the 15th amendment ensuring equal voting rights regardless of race...the 19th amendment ensuring equal voting rights regardless of sex...the Civil Rights Act of 1964 ... etc. etc.

Sure, evolution is a struggle...between the status quo (the 'thesis') and the energy of change (the 'antithesis'), resulting in a new synthesis which then becomes the next thesis subject to change.

Scalia is one person. One reason why the institutions of this country were premised upon majority rule, to moderate against extremism at either end of the political spectrum.

The Founding Fathers were not all cut from the same cloth....there was a lot of disagreement, and our Constitution is a compromise of viewpoints.
