I agree, evolution of rights occurred in many cases outside amendatory processes or even legislative, processes. Affirmative action is another case in point. However, it was the precepts and Bill of Rights in the Constitution itself that established the foundation for later judicial interpretations. Although the Framers probably did not envision such extra-constitutional development, they still get credit for enlightened principles and ideals, even if they could not completely realize the ramifications of those truths in their own lifetime. In fact, the contours of those basic truths will likely continue to be revealed, and folks 100 years from now will wonder how we could have been so ignorant.
