Dear Friends,
Below are the pertinent points on the anti-migrant proposals in the legislative Yuan by certain legislators. We will issue out a statement on this soon together with other anti-migrant/worker proposals of the CLA. The text is too long to have a word for word translation.
1. (Legislator Hou¡¦s proposal, which transfers the governing unit from CLA to EPZs management office, which is under the Industrial Bureau of the Ministry of Economic Affairs). In EPZ¡¦s the policy for local workers is No union no strike. This means that migrant workers cannot complain anymore to the CLA and the local labor bureaus but only to the management of the Export Processing Zones.
At present, I know of three EPZ¡¦s in Taiwan with many migrant workers.
a. Tantzu in Taichung where Fr. Joy has a migrant Center. There are more than 4000 Filipinos there and all are women.
b. Nantzu in Kaohsiung ¡V almost the same number of Filipinos and majority are women
c. Hsinchu Science Park ¡V we do not know yet the number of Filipino workers there. Of course in all these EPZ¡¦s there are other migrant workers of other nationalities. I have been to Nantzu and Tantzu.
2. (When migrant workers run away, the employers should report to the local authorities. After three months, if the police cannot find the run-away workers, the employers can apply for new workers to fill the vacancy.)
At present as long as the worker is not found, the employer cannot hire another migrant.
3. (About the fees for deportation and detention you already mentioned in the statement.)
4. (If the employer does not cause the death of a migrant worker, the fees for handling the death case should be paid by the Employment Stabilization Fund, not the employer.) This is under the ESA, but in practice and in the employment contracts of a number of migrants it is shouldered by the Labor Insurance for those covered by the Labor Standards Law.
