Dave, unfortunately it doesn’t seem to be in Mr. Pickering’s power to stop these releases.

I’ve now had further information from a reliable source in the record industry. It would seem that, as we were told in the deleted thread, the “licence” for the Picks overdubs is “owned” by the Charly label. However, their legal title seems to be flawed and it would appear that the original undubbed tracks may never have been licensed for this use by MCA. This is not to accuse Mr. Pickering of anything here. However, it appears nothing can be done unless MCA intervene – they haven’t seemed to be bothered so far – or unless a rich benefactor buys out Charly, who are currently sitting on a cash cow. Dave, e-mail me if you wish and I can be less guarded.

I understand that at least one release of these tracks in the UK resulted in sales of some 60,000. No royalties are being paid to the likes of the Holly estate or Messrs. Allison and Mauldin. Compare this with the sales figures for Gotta Roll, which I seem to recall (was this from Dave Penny?) were something like 3,000. So to give a wildlife analogy, it’s like the invading grey squirrel squeezing out the native red version. As others have said, I think overseas folks don’t appreciate the extent to which the market here is becoming saturated with these tracks. I remember when I was in Sydney, Australia fairly recently, I picked up a 4 CD rock and roll compilation in which the Holly CD was Buddy Holly and the Picks. Roddy Jordan can maybe comment on how widespread this is there.

Dave, as I said before, there are two sides to everything and we’ve never heard Mr. Pickering’s account of why he decided on this overdub project. There may be reasons he’s never revealed – e.g. maybe he was requested to do so by other parties. I just don’t know. Also, I doubt if he could have foreseen the proliferation of budget priced, tawdry compilations released for the lower end of the retail market. So I reserve judgement on this aspect of it. But as for stopping the releases it seems there’s very little that could be done.

I’m not sure if HK meant his point to be taken seriously. It’s true that in 1957 we all thought the Crickets did the background vocals but it was never actually stated that they did as far as I recall. They’ve certainly lost out on royalties from the overdub sales.

Volk, did you mean that people were buying the overdubs as an artistic preference or in ignorance of the real thing?
