If a homophobic person beats up two people, one straight and one gay, at the same time or seperately and he does not use words like "die you faggot, or die your Jew, or die n***er " then neither is a hate crime.

If he beats up the straight guy and on a seperate occasion beats up the gay guy, and on neither occasion uses words like "I hate all of you queers. I'm going to send you to Hell." then neither occasion is a hate crime.

If he beats up the gay guy either on a seperate occasion or at the same time he beats up the straight guy, and while he is committing the crime, he indicates that he is beating the gay guy because he hates gays by using words such as "faggot, queer, etc" in selected cities and a few states it might be a hate crime.

If there is a local or state hate crime law, it requires law enforcement officers to fully document what was said and done, and a determination is made whether this crime was a hate crime.
