In his "MEMORANDUM IN OPPOSITION TO DEBTOR'S MOTION FOR ORDER TO DISAPPROVE APPOINTMENT OF DAVID C. FARMER AS SUCCESSOR TRUSTEE", filed with the Court on August 24, 2007, the Trustee's attorney, Steven Guttman, Esq., of the law firm, Kessner Umebayashi Bain & Matsunage, stated to the Court:
"... Harmon is once again attempting to create issues of conflict where none exist by attempting to draw connections between phantom dots."...
Due to the fact that I continue to discover new, material FACTS almost daily, I'm preparing a large number of NEW EXHIBITS in which I will document the financial, professional, personal, and political connections between the many various entities involved in this case. Mr. Farmer, with all of these real "connecting dots" that are presented here, and in those which may follow, I believe that any "reasonable person" will clearly see that you and a number of other key witnesses in this case have clear conflicts of interests.
As you know, I have repeatedly requested that we attempt to NEGOTIATE A GLOBAL SETTLEMENT to these long-running lawsuits. You have not responded to any of these requests. If for some reason you still do not wish to attempt a negotiated settlement, then I ask that you, at least, advise me as to the REASON(S) you are unwilling to attempt such a settlement.
If you are unable or unwilling to disclose these reasons, then I again respectfully ask that you voluntarily resign from this position as Trustee. Otherwise, I believe that Judge Robert Faris should immediately remove you from this case for the appearance of bias, for bad faith, and for obstruction of justice.
