That's how my program is working too. I was told by an attorney (that had no stake in it), that he never faired well with a BON because they are not required to take anything he says into consideration. They are a governing board and answer to no one. Their supposed job is to make sure you are safe to practice, and they are not required to even set up and have a diversion program. (which my current state has only pretty recently implemented--- poorly I will add) They can look at you and say you are not a fit nurse and revoke you license permanently.
