My dui's were close enough together that one was a felony, even though I was no longer on probation. I didn't know at the time that I would have so much difficulty with a felony. If I had known I would have taken whatever jail time they wanted to give me!!! My lawyer wasn't versed in nursing issues, and I think his goal was a small sentence. Now I am screwed b/c Indiana doesn't let you expunge or anything. The first job I interviewed at told me they had not issue working with my restrictions, but the felony is a deal-breaker. They were a small hospital and some long term and short term patients were intermingled on the same floor. (ST being less than 3 week stay) If they were ever to be audited and their employees "checked", a felony would be a red flag. Although it wasn't for drugs or abuse, the threat of an investigation wasn't worth it. They could not prove that I hadn't taken care of long term patients with them being on the same floor. (without troublesome extensive record keeping and patient assignments) She said to try to apply at larger hospitals with designated floors. She also said that if I could get it expunged or decreased to a misdemeanor she would hire me. I wrote a long letter to my atty and explained to him the issue and my EXTENSIVE rehabilitation and devotion to recovery, outlining every single thing that I have done for 2 different states, and what I do on a daily, weekly, monthly, yearly, etc basis. He said that unless the prosecuting atty for the county in which I rec'd my felony was ever changed, it was unlikely he would allow me to decrease the charges. It has now been 7 years and I have finished my Bachelor's degree. My program runs until I begin employment as a RN, and continues for 3 years. I am hoping that my long rehab, and no issues with either board, as well as finishing my degree, will help in my favor. I'm HOPING, but I'm not getting my hopes up. I am being realistic. Good luck!
