Subject: breath

I got a question. I was thinking about the "vampires having no breath" thing the other day and was irrtated by an episode in season 7 where the Übervamp thingy tries to drown Spike in a little fountain in order to torture him....that's kinda pointless, right? Was it just a writer's mistake? Is that even possible after 7 seasons?

Just wanted your opinion on that...
