Subject: I would think if the design was publicly available then it's fair game. Can't copyright designs. Same as knockoffs of brand name garments/accessories.

The design wasn't publicly available, she used the design she rejected without paying for it. If you go to a shop and show interest in an item, then say you don't want it. Atually you can copyright designs, but it is expensive, takes time, and the amount you can recover if you "prosecute" is not enough to make it worth it for one dress design. The only thing stopping everyone from making copies is their integrity and the fear of losing their good name. Your best form of restitution is name and shame in hopes they won't do it again, but I wouldn't do that before contacting the dm first to allow for an explanation.
