Subject: How close is a copy? Look at dress 1145C on Dance Again and then on the featured Elevation dress. Are they not identical?

They are very similar, but not an exact copy. When you break it down, only the knot work on the center bodice is close enough to be considered "copying." The sleeves are different, the skirt is different, the back is different, the collar is different, and there are very slight differences in the front bodice design. The only person that has a potential claim anyway is Elevation, and it is not clear if they would win. Copyright is a very slippery slope. Technically, they probably changed 60% or so of the design. Realistically, the knotwork is an exact copy and the other changes look fairly minor when looking at them side by side. I cannot understand why anyone would copy even part of the design so closely. Surely it would be easy enough to use it just for inspiration, and come up with a slightly different design? I had a customer email me over the weekend that her dress had been copied by this very dressmaker. Both dresses are now in the same region and showed up at the same feis. Apparently the color placement is exact and the embroidery is an exact copy. Apparently a lot of people made comments about it because it was so apparently copied. I just looked at her facebook page and I've seen almost everyone of those dresses on BNDM sites. These are not inspired dresses people, they are copies! (NT)wowThursday, November 01, 08:31:47am

I've had this happen to me as a mom. I "designed" our perfect style dress we loved and had a dressmaker make it - and they supplied gorgeous embroidery and we love the dress. I was so mad to see a copy of it later in a different region. Embroidery was almost the same - I was first mad at the original dressmaker - but now I see they probably didn't even know about it!
