Subject: November 16 P and Z Public Hearing

I urge all to attend the P and Z Public Hearing on November 16. The items to be discussed are Cluster housing/Open Space Development, the special exception for 4 lots off a common driveway, and age restricted housing. The first two (cluster, and common driveway) were initiated by the Planning and Zoning Commission. The third, age restricted housing, is a public hearing to discuss an application which has already been filed which requires changes to the current P and Z guidelines. The application was filed by Framingham Commons LLC. The application and proposed changes are available at the town hall, and they will make you copies if you would like them. The proposed rewordings are also part of what you will receive.

I believe one of the major issues with the proposed changes to P&Z guidelines is the latitud which they allow the commission. The lack of clear black and white guidelines creates uncertainty that is bad for the town and developers. The developer is presented with a sitation where his application "may" be approved and the town is presented with nore opportunity to pay legal fees defending the commision's decision. If you read the proposed guideline changes, you will see that there is a great deal of decision lattitude given to the commission - a recipe for conflict and expense.
