Ski resort found not liable for teen's injuries

LITCHFIELD — It took the jury just over an hour to decide Ski Sundown should not be held liable for the horrific injury James Malaguit suffered when he flew off a jump at on the New Hartford hill and was paralyzed.

Ralph Monaco, Malaguit's New London attorney, vowed to appeal the verdict, delivered shortly before 5 p.m. Tuesday. The six-person jury began deliberation around 3:30 p.m. after hearing testimony for nearly a month about the history of skiing, the psychology of teenage boys, and the specifics of the last day Malaguit was able to walk: Feb. 16, 2006.

"Obviously, we're going to file a motion to set aside the verdict," Monaco said. "We intend to pursue our appellate remedies."

Monaco said the forthcoming appeal will be based, in part, on Judge John J. Danaher's decision to prevent the jury from hearing details of a 2005 effort to change a state law granting immunity to ski operators
