Subject: emergency order fishing

The commercial fishing industry has done it again...July 22, 2003.

It negotiated fisheries concessions from the public by claiming that it would also give up fisheries concessions.
The public was tired of back to back, seven days a week set gill net fishing so commercial, sport and subsistence users did a lot of work and finally came to an agreed solution.
The public made major fisheries concessions and commercial fisheries agreed to only allow 36 hours of emergency order fishing time near the Kasilof River.
As soon as the public fisheries restrictions were firmly in place the Kenai Peninsula Fishermen's Association and the Cook Inlet Drifters Association then filed suit to remove their side of the concessions, June of 2002.

In June of 2003, Judge Harold Brown ruled that the 36 hour limit on emergency order fishing time near the Kasilof River, was not legal because it allowed the
Board to place limits on the Alaska Legislature's EO authority.

This is a classic sample of what happens when you deal with an entire industry which
bargins in bad faith. How could anyone make a deal with an industry which operates likes this? Any person or industry who believes it can make "fisheries concessions deals"
with people like this, really should sit down and think long and hard about who they are dealing with.
