I don't have a whole lot of insight on affirmative action law in the US, but the way I understand its intent is that between two equally qualified applicants, the minority applicant is given preferential status. But I would think that to vocalize disdain for a particular "protected class" (and majorities are protected just as much as minorities in equal protection law) would imply that a less-qualified applicant would be given preferential treatment over the class for which the disdain was vocalized.
