HILARIO Singer and TV host Regine Velasquez denied yesterday charges that she evaded her tax obligations, but aired willingness to remit to the government whatever deficiency could be found in her payment of tax dues. As she showed up at the Department of Justice (DoJ) to attend its first preliminary investigation hearing on the complaint jointly filed against her by the Department of Finance (DoF) and the Bureau of Internal Revenue (BIR), the popular singer, through her counsel, requested a copy of the BIR’s record of her payment for comparison with the documents presently in her possession. She said checking the bureau’s official record would enable her to know if she did not pay her taxes in full in the past. A tax evasion complaint had been filed against Velasquez, for her alleged failure to declare P3.75 million in earnings from a product endorsement. BIR Commissioner Guillermo Parayno earlier said the agency found that Velasquez understated her worth in her statement of assets and liabilities for 2003. He said if found guilty Velasquez faced a possible four-year jail sentence and fines on top of payment for tax arrearages. "We are not filing a case of non-filing of declaration of returns at this time. We are saying that her having filed a return — the amount of the gross revenues or income declared is substantially understated by amount in excess of 30 percent, which under the national internal revenue code is prima facie evidence of fraud," the BIR chief said. But in her counter-affidavit submitted to State Prosecutor Rosanne Elepano-Balauag, Velasquez said while she was unsure of the accuracy of the income tax return prepared and filed for her by a representative, she never had any intention of defrauding the government of her tax due. She said her former business manager, a certain Patricia Mayoralgo, who was in charge of documents relating to her profession needed for preparing her income tax returns, resigned in 2003. No. Regine Velasquez yesterday formally denied the Bureau of Internal Revenue accusations that she tried to defraud government by evading her tax obligations in a counter-affidavit submitted to the Department of Justice. Dubbed as "Asia’s Songbird," Velasquez answered BIR charges of her alleged "attempt to evade tax and failure to supply correct" accounting from a her professional fee as product endorser of Nestle Phils., Inc. "I strongly deny any willful attempt on my part to evade or cheat any taxes imposed under the New Internal Revenue Code, and specifically my income tax for the taxable year 2003," said Velasquez. The BIR, which earlier went against another known showbiz personality, Richard Gomez, charged that Velasquez willfully attempted to evade and failed to supply "correct and accurate information" from her failure "to declare in her income tax return the professional fee derived from Nestle." The amount in question is P750,000 out of P3,750,000 which Velasquez contends was withheld by Nestle "for taxes in my favor" and is pursuant to model/talent contract entered into by and between Nestle and herself. Velasquez also submitted a certification from Nestle senior vice president Amorsolo Rosario which stated that she received P3 million for her services and that "any witholding taxes on the above compensation shall be for the account" of Velasquez and deducted upon payment. This means Velasquez’s P3-million fee is already net of taxes. "Most, if not all, of the contract I enter into contain the same provisions as above to ensure that the taxes due from my income would be duly paid by the withholding agent. How then could I have willfully attempted to evade the tax due on my income when as a matter of fact, I made sure that the same shall be paid by allowing it to be withheld by the source?" Velasquez stated in her counter-affidavit. She added that due to her extremely busy schedule as an artist, her sister Deca Pineda helps her in preparing her income tax returns but, sometime in September 2003, her road/business manager Patricia Mayoralgo resigned and another sister, Cacai Velasquez-Mitra, took over the job. Velasquez, however, admitted that this problem could have been prevented "if only I made time to carefully check the pertinent income tax return" but added "such omission or failure on my part could not have been willful for the purpose of evading payment of taxes." "If upon proper reconciliation of records of the BIR any deficiency be discovered in the taxes I had paid after proper assessment, I am very much willing as the same is my duty to pay whatever is due the government. As well as an continued attempt to keep her under "their" control. Who are "they?" Regine fans have pretty good ideas of their own thinking by now. What should be mentioned- Regine isn't the only one who had to deal with this kind of harrassment. Most do at the start of their rise in showbiz. They just broke down and gave in alot faster than someone with a strong personal character like Regine would. There is a real heavy showbiz expose here waiting to come out. The real story and the whole picture to it is so massive and huge that it is almost beyond anyone's simple comprehension now.
