Checklist Before Buying Real Estate in the Philippines

Here are the tips a buyer must remember before buying any property in the Philippines, specially if you are buying a single property from an individual:

1. Make sure the "Transfer Certificate of Title" is authentic. The easiest way to check if the title to the property you are buying is authentic is by getting "Certified True Copy" of the title from the Register of Deeds. This office is usually located at the city or municipal hall where the property is located. Ask the seller of the property for a photocopy of the title -you will need the title number and the name of the owner to get a certified true copy of the title from the Register of Deeds.

2. Verify that title is clean - meaning the property is not mortgaged (no liens & encumbrances on the property). You can see that at the back of the title with the heading "Encumbrances". This page must be empty if you are told that the title is "clean". But sometimes the space for the technical description of the property on the front page of the title is not enough and the description of the property is continued on the "Encumbrances" page, this is of course all right.

3. Make sure that the land described on the title is really the land that you are buying. You can validate this at the Register of Deeds or by hiring a private land surveyor or a geodetic engineer. Land titles don’t have any street name and number to pin point a property, it is a must to confirm that the actual property you are buying matches the technical description on the Transfer Certificate of Title.

4. Make sure that the sellers are the real owners. If you are buying from an individual property owner, ask for identification papers like passport or driver’s license, it is also a good idea to talk to the neighbors to confirm the identity of the sellers (you might as well ask some history of the property).

5. Confirm that the yearly real estate taxes are paid. Ask for a copy of the Tax Declaration and Tax Receipts to confirm that real estate tax payments are up to date.

If the above check list is in order, it is safe to proceed with the purchase.

It is with deepest sadness and regret that I announce the passing of Wilmyr Parpana-Paradero, 20-year old, eldest and only son of Willie and Myrna, loving brother of Wilma and Fema, beloved grandson of Engr. and Mrs. Manuel Parpana Jr.

Wilmyr died peacefully in his sleep on May 1, 2009.

I've always wondered how they cook this Ilocano dish. It has to be one of my favorite Ilocano dishes. Along with "dinardaraan", it is a popular dish in the Ilocos that people serve during the holidays, fiestas, occasions which they call "ponsiyonan" such as weddings, christening parties, etc. The liver, carrots, and peas just taste so good together. The cook substituted the carrots and peas with potatoes in this video. Now I know how to cook igado. Thanks to the person who uploaded this video. Hopefully I get to try to cook it one of these days. My Evening Star


She left in silence; left me to enjoy my night sleep. I glanced at her still body as I approached her bedside. There was a smile on her face, as if telling me she was happy to go. I felt peace settle down on me. I was glad too that she went. I did not have the heart anymore seeing her helpless, almost lifeless.

Watching my mother deteriorate everyday since her heart attack that rendered her totally paralyzed and in a comma six days ago was an elephant sitting on me. Her doctors served their best, but in vain. They gave her a week, and she glided away on the sixth day.

I was in the city in my last year of university when a telegram summoned me to go home, for my mother was in the hospital. Being an only child, I had to be present to tend to her. My father was killed in a freak accident at work five years back, hence, my mother and I lived with my maternal grandparents since.

My grandparents wasted no time when I called for them to help me with my mothers remains. We made all arrangements with the funeral parlor. I had no more tears left, for I cried them all while enduring the sight of her vegetative condition. I wanted her to go, more than anything. I asked God to take her home to him.

After the funeral, when all had left and I retired to my room next to my grandparents, I locked my eyes with my mothers eyes in her photo by my bedside table, and talked to her: Mother, you will always be with me, as always. From where you are, you see me and look out for me, even in my sleep. Your love will be my inspiration and my strength to live on. I will not fail you in your dreams for me. I will never be afraid to challenge my potential, for you are my cushion in my falls and my light in my doubts. Your memory will pull me through any adversary.

My mother has been with me all the way, and will continue till there is life no more. My two children have prospered, married and each given me adorable grandchildren. As I lift my eyes to heaven, I praise the Lord for blessing me with the greatest mother on earth, my evening star.

I have read the activities of the 5th TIKANLU FESTIVAL of Tagudin and the fiesta is mostly a celebration of women, such as Mrs Barangay, Miss Tagudin, Flores de Mayo, Bb. Tagudin(Perlas ti Amburayan). It looks like a one sided celebration. WHERE ARE THE MEN? Are men not worth celebrating? or worth of recognition?

As far back as I can remember, men activities for Tagudin Fiesta was only limited to basektball tournament, and now I guess bikathon as well.

A conversation at a fast-food restaurant in the Ilocos


I have noticed that majority of the attendants at places like fast food restaurants and malls in the Ilocos use Tagalog to communicate with their customers. When I was living in the Ilocos, it was not common to hear people talking in Tagalog especially in the smaller towns. I guess it is because there were no fast-food restaurants and malls yet at that time. Because of what is happening in these places today and the influence of peers and the media especially television, the use of Tagalog is now becoming more and more common in places like hospitals(especially in the more expensive ones), offices, school grounds, and many other places. Ilocano is still the primary language in the Ilocos region at the present time but as an Ilocano person, I am concerned that sometime in the future Tagalog could replace Ilocano which might make Ilocano obsolete if we continue to allow it to be neglected. I do hope that Ilocano will never become obsolete in the Ilocos for the Ilocano language is what makes our Ilocano culture. I believe if we lose our Ilocano language we will also lose our Ilocano culture.

Concerning the use of Tagalog by the attendants at the fast food restaurants and malls in the Ilocos, I am not sure why that is happening in those places. In my opinion, I think it is a little out of place. First of all, why would they be speaking in Tagalog if they know that most everyone they are serving speak Ilocano. I could relate if these attendants are the non- Ilocano speakers from the other regions such as the contract workers being sent by the work agencies but most of the time these attendants are Ilocano speakers. Secondly, it is making it more difficult for the customers of these businesses to communicate especially the senior citizens and other folks who have difficulties speaking in Tagalog. At first I thought it was a marketing strategy for these fast-food restaurants and malls so they can attract more customers but I’ve learned that does not seem to be the case according to what I’d found out when I visited a mall in one of my vacations in the Philippines. During that mall visit, I was told to speak Tagalog by one of the sales ladies after talking to her in Ilocano. Curious and a bit annoyed, I asked the sales lady if it was her employer’s policy to have them (her and her co-workers) speaking in Tagalog and she said no. My insistence of not speaking Tagalog was not because that I don’t speak Tagalog for I do speak Tagalog fluently. I just didn’t feel comfortable speaking Tagalog while being in the Ilocano territory.

I don’t have anything against the Tagalog dialect nor I want to have it totally prohibited in the Ilocos area. As we know Tagalog is our national language and it will always be the communication medium we would use when we go to the different regions in the country. I guess I am just for the total preservation of the lIlocano dialect. I don’t have anything against the Tagalog people either. In fact, I appreciate the Tagalog folks for when they come to the Ilocos, they(at least the ones I came in contact with) try to make efforts to speak the Ilocano dialect. They are also very proud of their Tagalog heritage and dialect. In contrast, a lot of Ilocanos seem to be ashame of their own native tongue as I had observed at the fast-food restaurants, malls and other places in the Ilocos. I don’t fully understand why these folks in those places feel that they need to speak Tagalog but my guess is, Ilocanos like to follow trends and those folks perhaps want to be trendy or what they call over there “sosyal”. Fast-food restaurants and malls are considered trendy or fashionable in the Philippines and Ilocano is stereotyped as being associated with being poor therefore in those places, they would not use Ilocano but instead they would use Tagalog since it is usually more associated with being hip, cool, or rich probably because of the influence of the media such as television and others as I have mentioned.

No one can dictate us on what kind of language/dialect to use in the Ilocos or any place for the Philippines is a free country but as true Ilocanos we should also give importance to the preservation and protection of our Ilocano language because it is part of our Ilocano heritage. I think it is beautiful language. We should be proud of it.

Re-greening Tagudin

Planting trees can definitely improve the environment, the economy and the quality of life of any town so in order to make Tagudin green and one of the greenest towns in the region, we need to plant more trees and in addition to taking care of the existing trees that we already have such as the century old acacia trees particularly the ones at the town plaza. I cannot imagine our town plaza without the old acacia trees for they have been there for many generations. Along with the old sun dials, they are the symbols of our town. I remember feeling sad when they cut down some of the acacia trees sometime in the late sixties or early seventies. I wasn't sure what the reason why they cut them down but I guess it was to make way for the new plaza. In my opinion they should had just incorporated the trees with the plazas design so they didn't have to remove them. We've lost a few more through the years from various causes as we had talked about here in the MB in the past but what is more important now is for us to be able to save the remaining ones. I have noticed that the area around the base of some of the acacia trees is covered with concrete pavement. I wonder if that is okay since water can no longer reach the ground. For the dead trees, I think it is a great idea to have them replaced. It would also be great to plant more trees if there are any more open spaces for trees in the plaza. Aside from Marungay, Katuday, Mahogany, fruit trees and other kinds of trees, ornamental trees such as the Fire Tree, Golden Showers, Banaba and others can also be planted in our town. These ornamental trees are beautiful and they are perfect for planting at the plazas, along the streets and especially along the highway. I can just imagine having these trees planted on both sides of the highway from Bio to Becquez. It would be a beautiful sight to behold thus attracting a lot of tourists. These trees along the highway would not only beautify the town but they would also absorb carbon dioxide. I had seen these trees in Tagudin before but I dont see them anymore. From what I remember, there used to be a Golden Showers tree on the side of the waiting shed along the highway in Las-ud. That waiting shed at the "pagkurbaan" is no longer there. To me, Golden Showers tree has to be the most beautiful ornamental tree in the tropics such as the Philippines.

The great news received, I was thrilled beyond words. A close friend & classmate of Edna since childhood, I was thrilled for the family. I booked a hurried flight to SF. The 2-mi+ parade fr Civic Arts C. to Japan Town was packed w/ throngs (close to 100,000) patiently waitng for the parade that started at 1 PM. Crowds (all colors) lined the curbs, propped themselves up on fences or just stood by to watch the parade. The Grand Marshall was the actor, George Takei, of Star Wars fame. The parade, aside from Eri's court, was graced by the presence of the Japanese Ambassador to the US, the Japanese Consul General in SF, CA officials like decorated military veterans, law-enforcement chiefs, supervisors/commissioners and community leaders. Bands, drums, dance groups from Japan, multicultural costumes galore, etc. kept the festive mood glorious and merry till the close of the parade. For me, the humbling message of this experience is that here in America, one can leap to the top by merit alone, not by money or political clout. Eri got the title by personal merit: natural attributes, genuineness, integrity, beauty and brains.

Congratulations to my niece, Eri Tagaya, who was crowned 2009 Cherry Blossom Queen of Northern California on Saturday, April 11 at the Kabuki Theatre in Japan Town, San Francisco. She was also chosen by her fellow finalists to receive the Tomodachi Award, equivalent to a Miss Congeniality Award. Eri is the daughter of my cousin, Edna Lardizabal Ventura Tagaya (SAS class 62) and Sam Tagaya of Mill Valley, California. The Lardizabal clan of Tagudin is so proud of you, Eri!

Donaire, Viloria stop opponents

Filipino-American flyweight Nonito The Filipino Flash Donaire and junior flyweight Brian The Hawaiian Punch Viloria stopped their respectrive opponents Sunday at the Araneta Coliseum to give the Philippines a new source of pride in boxing in addition to Manny The PacMan Pacquiao.

Donaire, who was featured in the main event, retained his International Boxing Federation (IBF) and International Boxing Organization world flyweight titles with a fourth-round technical knockout of erstwhile unbeaten Mexican Raul Cobra Martinez, who came to the fight with 24-0 record with 14 knockouts.

Inspired by the presence of a hometown crowd, Donaire knocked down Martinez in the fourth round with a left uppercut, which forced the referee to stop the fight with only 12 seconds left in the round. The crowd included former President Joseph Estrada, Vice President Noli De Castro, Ilocos Sur Gov. Luis Chavit Singson and Donaires girlfriend Rachel Marcial.

In the first round, Martinez , a Mexican-American, hit the canvas twice after Donaire connected solid right hooks on the challengers face. Martinez also hit the deck in the second round.

Im very proud for all your support, said Donaire Jr., who handed Martinez his first loss. This is a big fight for me, so I worked hard and its good that it paid off.

I knew my punches would land because he sits on his punches, said Donaire. I knew because of this, if I landed mine, it would hurt more. My right hand was something he didnt expect. I am so thankful to everyone here.

Donaire said he felt nervous before the fight because Viloria scored a thrilling victor over his opponent.

Although Martinez fought with his guard up for much of the fight, Donaire used his speed and reach advantage to pound the Mexican. The Filipino improved his record to 21-1 with 14 KOs.

In the supporting bout to the main event, Viloria thrashed Ulises Solis of Mexico in the 11th round to capture the IBF junior flyweight title. The Viloria-Solis fight proved to be more thrilling than the main event, as both boxers traded punches to the delight of the crowd.

But it was the The Hawaiian Punch who landed the more telling blows. Viloria then caught Solis with a counter right cross in the 11th round which saw the Mexican fall to his knees and crumble to the canvas, where he was counted out by the referee.

It was a long year. We fought five fights in places people shop. It feels good. We had to stay focused for all 12 rounds. I had to let my hands go. Thats my strength. [Solis] has a great jab. We had to sneak in a few right hands. My right hand has been perfect in training camp.

Viloria is now 25-2 with 15 KOs while Solis, who has beaten three Filipino boxers in the last two years, dropped to 28-2-2 with 20 KOs.

Our condolences to the family of the late Angel Fabro Bustamante, who passed away last March 20, 2009 here in Hawaii. He is the brother of Manong Larry Bustamnate and brother-in-law of Manang Marietta Somera Bustamante. Visitation is scheduled on Thursday, 5:30 pm and service at 6:30 pm at the Hawaiian Memorial Park Mortuary. Visitation is also scheduled on April 17, 2009, 9:30 am, and mass at 11:00am at the Co-Cathedral of St. Theresa. Burial will follow at 12:30 pm at Valley of the Temples Memorial Park.

Is there anybody in Tagudin who can help my mother?

Here's a situation: One of my father's relative in Tagudin solicited a sale of her rice land to my parents during the years of 2007 and 2008 in which it was paid in full in the agreed amount. It has been brought to my attention that since the sale of the aforementioned rice land to my parents that they have been prevented from utilizing the land for their own used.
My father passed away in August 2008. My father's relative who sold this parcel of rice land was not truthful at all. She sold the land to my parents without telling them the truth about the land. She borrowed an amount of $20,000(Twenty thousand pesos and have this piece of rice land as a collateral. My mother found out when she went in Lacong to the person that my mother thought is responsible and taking care of the rice land to collect her share of the crop. My mother was very dissapointed and went home empty handed. This person has been avoiding my mother, she made excuses and promises to talk to my mother. My family didnt't expect to be cheated nor scammed by a relative. My father trusted her because she is a relative. I was aware of the transaction made between her and my parents but not in writing. Please my mother needs help. She's old and she doesn't know what to do. My parents have been scammed and they need justice.

Dear PAO,

I am an American citizen residing in the United States. My 84-year-old mother, a Filipino citizen, executed a will stating that the real property she owns in the Philippines will be given to me, while her personal properties will be divided between me and my two sisters. What information do I need to know in order to have her real property transferred to me upon her death? What will be my tax liabilities? Thank you and we hope for my mother to live for 101 years.

Dear Mr. Peaflor,

The rights to the succession are transferred only upon the death of the decedent.

Upon the death of your mother, you and your siblings should file a petition for the settlement of her estate. As provided under our laws, if your mother was an inhabitant of the Philippines at the time of her death, her will shall be proved and her estate settled before the Regional Trial Court of the province where she resided at the time of her death. On the other hand, if she was an inhabitant of a foreign country, the petition must be filed at the Regional Trial Court of the province in which she had an estate.

Whoever is in possession or has custody of her will must submit it before the court within 20 days after he or she knows of the death of the testator. The submission is necessary for proper allowance of the will.

If the court finds that the will was duly executed by your mother, the allowance of the will shall be granted by the court. Section 13, Rule 76 of the Rules of Court the law provides: If the court is satisfied, upon proof taken and filed, that the will was duly executed, and that the testator at the time of its execution was of sound and disposing mind, and not acting under duress, menace and undue influence, or fraud, a certificate of its allowance, signed by the judge and attested by the seal of the court, shall be attached to the will and the will and certificate filed and recorded by the clerk of court. x x x

Consequently, upon the allowance of your mothers will, payment of estate tax and debts of your mother, if any, should be made. In accordance with Section 84 of the National Internal Revenue Code, the amount of taxes to be paid for the transfer of property shall be computed based on the value of the estate. If the value of the estate is not more than Two Hundred Thousand Pesos (P200,000.00), it is tax exempt. However, if the value of the estate is more than Two Hundred Thousand Pesos (P200,000.00) but not exceeding Five Hundred Fifty Thousand Pesos (P550,000.00), the amount in excess of Two Hundred Thousand Pesos (P200,000.00), shall be taxable at the rate of five percent (5%). If the value of the estate is more than Five Hundred Thousand Pesos (P500,000.00) but not exceeding Two Million Pesos (P2,000,000.00), the tax shall be Fifteen Thousand Pesos (P15,000.00) plus eight percent (8%) of the excess of Five Hundred Thousand Pesos (P500,000.00), and so on and so forth.

In view of your obligation to pay the necessary estate tax, you and your siblings must give a written notice of death to the Commissioner of Internal Revenue within two months after the death of your mother, and the corresponding estate tax return should be filed within six months from the date of the death of the decedent.

After payment of taxes and debts, the court, on proper application, shall assign the residue of the estate to you and your siblings, naming each of your shares. Lastly, certified copies of the final order and judgment of the court relating to the partition of the estate shall be recorded in the Registry of Deeds of the province where the property is situated.

Please be reminded that this opinion is based solely on the facts you have narrated and our appreciation of the same. Our opinion may vary when other facts are changed or elaborated.

A Filipino lady was ! taking the exam for US
naturalization and citizenship.
She aced the test. The examiner said, "Now, the last
part of the exam is a vocabulary test. Can you spell
the word 'Window?"

The lady said, "W-I-N-D-O-W.";

"Ah, very good,", the examiner said. "Now, use it in a
sentence."
"WINDOW I get my citizenship papers?"
