I wouldn't dismiss this as merely a crime of passion. Dad's passion for his daughter is unlimited. Beyond that, his protective instincts are much greater. I'd say sacrificial for most dads.

Hilder said Texas law provides several justifications for the use of deadly force, including if someone commits a sexual assault. So the dad was within the law.

I wouldn't normally consider use of fists as a deadly force, but they could be and you could strangle someone with your hands.

I just wonder if there was a point in the assault where the dad's blows went from protective to assaultive to revengeful. Hard to tell what is in a man's head. Hard to tell where dad's instinct for defense became an instinct to kill. Hard to tell whether dad intended to disable or to kill. Hard to tell how many blows were landed. We have to presume dad innocent without any witnesses.

I can't think of a more egregious assault other than death. However we do not give the state license to kill. Should we give it to dads? Why?
