Subject: WTH!!!! This will effect a lot of people.

There is a new law that goes into effect Feb. 10th that will require lead and phthalates testing on any product intended for a child under the age of 12, including new items as well as handmade and used. The testing is quite expensive, of course, and although a major toy manufacturer who produces toys in batches and can have the batches tested, can certainly absorb the cost, someone like me, who may want to sell a used boutique outfit on Ebay will not be able to legally do so without testing certification.

This has been circling all ovder the internet and sounds like Bs but it's true. The Consumer Protection website the law is written in it's entirety and this stupid blanket law has been passed. I shop for many of my children's clothes from consignment stores especially play cloths. In this economy every dollar spent counts. I also buy my child very nice name brand clothing on sale, with the knowledge that I can re sell it when they out grow them and there has always been a good market for resale name brand clothes on eBay etc:

Safety of our children is always top priority for all of us, but this law has many flaws that essentially drive the small guy out of business and will basically force us to buy new items for our kids and then throw them in the trash when they are used or outgrown. We will no longer be able to re sell our pageant items either, without testing, or purchase them from the designers because this law requires lead and phthalates testing on any product intended for a child under the age of 12, including new items as well as handmade and used. The law is very expensive so while major clothing and toy manufacturers may be able to afford this edxpensive testing small business owners will not. Neither will eBay sellers, pageant designers, or people holding a garage sale will need to have the items they are selling tested and certified! This law goes into effect February 10th.

It is not only about toys, but all children's products including those made BEFORE the deadline. According to this law, what is legal to sell on Feb 9th, new or used, becomes illegal to sell after this time. And it is a felony.

If this concerns you as much as it does me, contact your representatives. This website is pushing hard to create an exemption for micro business, similar to that offered to tiny food manufacturers, who do not have to clear FDA.
