Subject: Synopsis of Nov 14, 2017 River Oaks City Council Meeting

The meeting started on time. Councilman Scott absent and our usual city attorney was not present either and they sent a very young replacement.

Firs item was the consent agenda as usual. Nothing pulled off to discuss so the motion passed.

Next item, and just when you thought you had heard the last of the Keith Steele Rule, it's back! The homeowner at 1220 Yale was requesting waiving the 75% masonry rule for a garage/accessory building. I'll post more on this later, but this brings up all kinds of questions. Councilman Holland seemed to question allowing a garage on the lot next door to the homeowner primary structure. It was explained by Marvin that the homeowner purchased the property, had it re-platted into one lot, therefore allowing to build the structure. The new zoning rules on accessory structures was that any garage should be built out of material similar to the home. What made this come before council, although its not said in zoning, is that this structure will be visible from the right of way and would be in line with the rest of the homes on the block. Holland questioned could it be moved to back yard. Sanders stated no. No enough room to move it back. Holland then questioned the size of the garage,which is the exact sq footage of the primary structure,which is according to zoning, voted on and approved by council just a few years ago. Councilman Ashton moved to make a motion to approve allowing the structure to be built out of metal due to the fact the property owner had started this process long before the new zoning rules were passed. In fact, he is ready to pour now. Holland then questioned Ashton if another citizen was to start the same process now, would he approve it for them? Ashton explained that he would take every issue on a case by case basis. Ashton then restated his motion. It was seconded and passed on a 3-1 vote. Holland voting no.

Items 8 and 9 are tied together so I will report on them together. The library is requesting to be closed from Dec 4-26 for remodeling all the library shelves. Funding for this project came from the Tocker Foundation and the library dollar donations. A lot of the work of moving shelves out and books out will be done by our city staff. Both items were approved by council.

The next item was suppose to be allowing a sign variance for Charles Clark of Royal Granite and Flooring at 2621 Jacksboro Hwy (the old vacuum cleaner building at Long and Jacksboro Hwy}. This item was tabled due to a misunderstanding of the size of the signs that can be placed on the building. This public hearing will be re-opened at council on Nov 28.

Council also tabled Ordinance 1161-2017. This was a zoning ordinance requested by the zoning staff to have a rule for outside storage of personal property. The city attorney felt uncomfortable with the wording because it left open you couldn't have anything in your front yard. This would also pertain to what had under your carport. They showed several pictures of examples. Most were what we would consider junk and debris. The mayor questioned with the current wording, could you even have a chair on your front porch? The mayor then asked the city attorney if he had every dealt with this issue before. the attorney stated he has written an ordinance for another city and he could bring it back to the next council meeting. So this item was tabled until Nov 28.

Council approved Ordinance 1171-2017 for 15,130.00 to come out of the water fund budget to repair the house at the water treatment plant.

One thing reported by Gordon Smith, but not on agenda, was the sidewalk at Churchill that was requested by citizens to help get kids to the middle school without walking in the street. Gordon reported notices would be going out to the homeowners and progress on the project should begin in the next few weeks.
