Wow - Looks like Ruth & Tommy are busy making money on Downeys. Perry a board member is now being paid $50 per hour to fix roads. Tractor was sold to Diane B. Tommy's partner in his lawnmowing business. Think that sounds "Fishy" to.
Why don't we all just throw our money at Ruth & Tommy & Perry.
Statutes state that you cannot enrich yourselves at the expense of the maintenance fees.

Shame on you and the new board...

New people are moving in that will recognize

If any of you would like to know the TRUTH (as opposed to what this obvious ex-board member has posted), here goes:
1. Perry is NOT being paid to fix our roads. We (the board) voted to rent the equipment & Perry DONATES his time to do the work. And he's doing a damn fine job! This was all in the minutes, which were printed in the Sargent's News.
2. The association tractor was NOT sold to Diane B. It was sold to the highest bidder, Burt & Diane Kucera.
3. Tommy does not have a partner in his lawn mowing business.
4. I have not contacted the county or FEMA or anyone else regarding the trailers here in Sargent. If you or your son live in a camper, I don't care. I'm proud that you have somewhere to live, trailer, camper or 1/2 a house.
5. One trailer on your lot, 2 trailer, 4 trailers, I don't care. My "Good Friend" owns an RV park & it's full, so "no name" needs to get over her resentment at being ousted from the board. Why such sour grapes over a volunteer position that has no salary attached?

When we purchased our lots they were valued at $2,500.00 per lot. They are now valued over $75,000.00 per lot. We have had travel trailers on them the whole time. There is no telling what they would be worth if they would have just been sitting there empty. That being said if you are that worried about you property values dropping YOU should sell now and get the HELL out while you can. I am sure most of the good people of Sargent will even come help you PACK.

Real brave throwing accusations out there and not putting your name with it. Why don't you grow a set or take a mydol and put your name on this post. Custer owns the gun shop located where his Mom's cafe used to be located, 2 miles south of Sargent.

If anyone needs any 350 gallon storage totes ( good for storing water during major storms )I have them. They are free. My company throws them away. I triple rinse them for over 3hrs before I bring them home. Some of you have gotten some from me to collect rain water. I have one set up under my ac unit to collect the condensate and after 5-7 days I have about 300 gallons of water I use to water my lawn. Its first come first serve on these totes. I usually get 4- 6 sometimes more of these a month so be patient if I'm out. You can reach me at 979-257-3222.

DCCCLOA has no deed restrictions in reference to RV's.
The county requires an annual permit.
Contact them at 979-244-2717 for info.

I am a weekender on the creek in Sargent and the last several weekends I have seen to many near miss accidents with people running up and down the creek pulling tubes. Remember, the creek is not very wide and the tube can get out of control quickly. A 15 year old girl was just killed last week when her friend recklessly but accidentally slung her into a dock...happened in Reddington Shores, FL.

If you are a boater passing another boat which is pulling a tube, PLEASE slow down a bit and exercise caution...You DONT have to get anywhere that quickly.

Seems people are forgetting that the creek is not a speedway. 40 on the creek is WAAAAAAAAAAAY to fast...I have young children!!!!!!!!!!!!!!!!!!

Cobra Zone vs traditional area of Sargent Beach Addition -- Vickery (not convinced), 20:36:17 09/28/11 Wed [1] (c-98-194-22-22.hsd1.tx.comcast.net/98.194.22.22)

Since there are some stubborn people who insist the Cobra Zone at the far east end of the island is the same as the traditional part of the island, I will explain the difference.

As you know, Canal Drive disects the traditional part of the island. Why traditional, because it is FEMA insurable. And Canal Drive is an all weather road maintained by the county of Matagorda. So, you likely can readily get a loan to build your dream home providing you have adequate credit and equity, and providing banks are lending for such purposes. So, I think we can assume such loan would be a relative safe bet for a lender, wouldn't you agree.

Well, apparently the developer never got around to completing the roads and whatever infastructure at the far east end of the island as he did in the traditional part of the island. And sometime mid 1980's the governmental branch, FEMA, drew a line on the island and decided to not insure the undeveloped part of the island and labeled/designated the area as the COBRA ZONE! To date nothing has changed so the area remains the same with no county road maintenance at all!

There are a large number of these Cobra Zone lots, approximately 65 of them. We purchased 18 of these Cobra lots back in 2001 and were not informed of such although we purchased thru a local realtor as well as from a couple of attorneys! I question what the other Cobra lot purchasers were made aware before purchasing and doubt they had any idea of how difficult, IF AT ALL, reversing the Cobra designation would be and what is to come regarding the non all weather roads. Therefore it is my opinion the highest and best use for the Cobra lots is for rv use and according to most other Cobra lot owners, they feel the same. Let's let the now, proposed Director but back in April proposed officer, get this Cobra designation reversed, before we in the cobra agree to anything. And then lets let this proposed POA get our roads brought up to the same standards as the blacktopped Canal Drive before we Cobra owners agree to anything!
I still can't help wonder why this particular proposed Director didn't fix the Cobra thing if it was so easy, BEFORE SHE SOLD SOME 23 OF THESE COBRA ZONE LOTS!

Folks, why is this proposed POA wanting so badly to get control of my and your property? DO you really think they can make a difference which would add value to any of our lots? I do not but will listen to reason. Otherwise I plan to post the reason I think this group want control of our properties at some point in the near future!

PLEASE KEEP YOUR COMMENTS COMMING AS WELL AS SUPPORT FOR OUR PROTEST OF THESE SELFISH PROPERTY OWNERS!

Today I called Matagorda Sheriff Dept. After being transfered a few times I was told they would have to get back with me when they could find an answer for me. Next I called the Local JP, I was told to call back tonite around 7pm to speak with the judge about it.

I never thought this would be so complicated of an issue, especially at sargent. I grew up going to sargent with my grandpa who built and used to own a place on gulfview. Years ago, there were far fewer rules.

Hello.
I am thinking of purchasing Utility Vehicle (polaris ranger), for the sole reason of driving to, and fishing Mitchells Cut. I know that Jeeps and other 4x4s can drive the beach, but is it legal to drive a UTV down the beach? Im looking at purchasing one in the next few days, so a quick reply would be appreciated. Thanks.

THE LADY WITH THE RE-SUBDIVIDED LOT WILL LIKELY OPEN THE MEETING. OF COURSE THAT WILL BE SOFT SOLD AS JUST FINE BECAUSE SUCH WAS DONE BEFORE OR SOMETHING RIDUCULOUS LIKE THAT. BUT, IF YOU ARE GOING TO REGARD YOU NEED TO OBEY AND IF SUCH WAS ALREADY DONE, DON'T PARTICIPATE IN THE VIOLATION IF YOU REGARD SUCH NEGLECTED RULES!
THEN THEY WILL SHUFFLE AROUND AND LOOK FOR WORDS TO SAY.

This June, Rick Perry called a special session to reform the Texas Windstorm Insurance Association. What came of the law was nothing to help TWIA policyholders. Perry cut short negotiations and legislators adopted the worst possible law for property owners along the Texas coast. This law treats TWIA policy holders like second class citizens. The new law will probably result in higher costs to take a claim to court for TWIA policy holders than other insurance holders. The new law also strips consumer protections requiring windstorm insurers to investigate their claim in a timely manner. Perhaps the scariest part of the bill is the so-called “expert” panel, an unelected, unaccountable panel that is created to investigate all TWIA claims. We deserve the right to hold the people accountable who are creating new guidelines for the insurance that is supposed to cover our property. Lastly, the new law is retroactive, meaning it destroys current contracts. All in all, I couldn’t have conceived a worse law for TWIA policy holders. You can find out more at www.twiatruth.com

The entire community of Sargent is working together to host 94 wounded soldiers for a great weekend of fishing and fun during the Fifth Annual MSgt. Gonzales Memorial Fishing Tournament on Friday, June 24 until Sunday, June 26.
About 94 wounded warriors from Ft. Hood, Brooks Army Medical Center and Walter Reed Army Medical Center will have an opportunity to enjoy a free weekend of bay fishing, great food and great hospitality provided by a group of Sargent residents who open their homes and act as fishing guides in an effort to allow these heroes to enjoy a vacation in the outdoors.
The fishing tournament is, of course, free to the 94 military personnel, but is also open to the public and the money made on entry fees and silent and live auction sales will be used to offer the event free for wounded soldiers year after year.
The fishing tournament provides an excellent opportunity for grateful Americans to show their love and support for these heroes in a very personal and tangible way as volunteers invite the soldiers into their homes and enjoy some face-to face-conversations with the ones who have sacrificed so much.
It isnt just the home hosts that will have the chance to meet the soldiers and say thank you, all Matagorda County residents are invited to line the roadway between LeTulle Park and Iron Cactus Restaurant in Sargent to wave flags, raise signs and just stand in support of the heroes as they pass by in a convoy that will be escorted by the Matagorda County Cavalry.
The convoy is expected to pass through Bay City headed East on Texas 35 toward Sargent about 3 p.m. on Friday, June 24.
Also, the community is invited to attend a tournament kick-off dinner at the Iron Cactus in Sargent on beginning about 4 p.m. on Friday, June 24.
Those who attend will enjoy a Hawaiian Pig Roast dinner and social with the soldiers. The dinner is $11.95 per person.
The tournament is still looking for volunteers who can take soldiers out on their boats for the tournament and host them in their homes.

I can't belive what I saw last Saturday in Sargent. I was on my way home from work and it started with 2 different idiots in trucks on 457 just north of Woods Liquor Store. The lead truck was driving about 40 and weaving all over the road, the second truck was just as bad and throwing empty beer cans out the window. I was able to pass the truck in front of me and while trying to pass the lead idiot, he sped up so I couldnt pass. It was like this till just before the Texaco where he turned. This Idiot didnt even have working brake lights or turn signals.
I had just passed the Texaco when an approaching truck came flying towards me. The cab of the truck was packed with kids as well as the bed of the truck, and these kids were standing up.
I thought I had seen it all so far, but oh no. The best was yet to come. I turned on Carancahua and low and behold there was a truck doing 5 miles an hour following a golf cart with four children in it. Two where on the front seat and two where standing where the golf bags should be and they where jumping up and down. I guess they where trying to make the cart do a wheelie. I am going to assume the truck following where their parents cause they gave me a dirty look when I passed them both.
Do these weekenders leave their brains, manners and common sense at home when they come down here. Am I the only one who sees this and voices his concern about this. I hate to see kids get hurt but I can only blame the parents for their action.

always the weekenders huh. nevermind the trash left on the beach during the middle of the week or the properties that get broken into while we so called weekenders are not here

Hello friends -
Just a quick notice to all....today our gardener killed a rattlesnake on the concrete on the underside of our house (where we park cars). Several hours later, Don killed another one slithering across the concrete on the underside of our house also, by the steps going up to the entry of our house. These two were killed in the day light...not at night. BE ALERT AND AWARE OF WHERE YOU ARE WALKING! THEY ARE OUT AND ABOUT. Last year we did not see any of the little critters around here.
I also saw one on Sunday morning while walking my dog that a car had evidently run over on the beach access road! In addition I have seen some snake skins (well, only one) that had been shed on the beach access road, also.
PLEASE BE ALERT AND WATCH WHERE YOU WALK!

1. When you bought the lots did you Pay a $50.00 Transfer fee on each lot. If so this fee is illegal..Per the by-laws

2.Did you pay any maintance dues, if so how much and how far back. If over 4 years this fee also is illegal .

3.Did you check with the county to see if there were any liens from Downeys, if so they were also illegal placed by Downeys..

4.Did you ask to see the books, if so did you see them..Bet you didn't see books..

5.Did you ask if the lots were in good standing...........

The quit claim deeds that you have now , will be a problem later on....Most of the Title companies do not acknowledgeable Quit deeds now, due to the trouble in transferring them.

Please come to the meeting the 26th and vote !!!

With all the commotion concerning DCCCLOA, I have some questions I would like answered as I have not seen them addressed in this website nor in the newsletter.

1. Who are the candidates that are running for election to replace the existing board?

2. Are all the members from the DCCCLOA existing board running for re-election?

3. If a replacement board is elected will the following items be taken care of:
a. will the abandoned trailers and structures be removed?
b. will a contract be issued to spray for mosquitoes in Downeys?
c. will the replacement board lobby with the county about improving and paving roads, improving drainage and improving beach conditions?
d. will annual maintenance fees increase?

The February 26 date is fast approaching. A second lawyer is now in the picture and lot of money has gone out of town with the first one. After all this time, it would be nice to know when we will not hear about this topic any longer and start spending the money spent on lawyers to improve Downeys instead of on lawyers.

You Need To Hear Both Sides!

When a 3-page article concerning the Downeys Lawsuit appeared in another local paper, the Sargents News received several phone calls from supporters requesting that we print an article to clear up the many misconceptions presented in that article. So many people who have stood by us and supported us through this ordeal convinced us that since an election for new board members is coming up in just 6 weeks, we need speak up. So, here goes

1. They state that the temporary injunction prevented any action by selected board members. NOT TRUE, they were ordered to conduct normal business activities, just no special purchases or sales of assets. And NO selected board members were picked out. Every board member was included.

2. The board seems convinced that we did not have 25 signatures of members in good standing on the request for a special meeting. NOT TRUE. While there were some signatures there that were not in good standing, we still had over 25 good ones.

3. OK, so the laptop was stolen. But why would some teenage boys take minutes of board meetings? And, yes, it is interesting to note that no other electronic equipment was taken.

4. Yes, documents were received at our attorneys office dating back to 1974. Records from the 70s & 80s were not needed. All records were returned in the same disarray in which they were received. We asked for financial records. Only about 10 invoices were received. Over a years worth of bank statements were not there. To this date, the board has still not submitted all the bills, bank statements and check stubs.

5. It is NOT a fact that two of the plaintiffs placed liens on properties while we were on the board. It was discussed in meetings, but was decided against.

6. The board claims that the membership voted to change board term limits from 2 years to 4 years. According to the ballots turned over to us in their paperwork, it was turned down by the voters!

7. They claim that when plaintiff Mary Ann Dittert & family went to the office to see the financial records, they were arbitrary & threatening . We have all this on video. You would be welcome to see it there are NO threats, not even a raised voice.

8. We did NOT demand a special account be set up for lot owners to pay maintenance fees. We suggested it and the boards attorney agreed, no problem. Why have no maintenance fees been deposited? Maybe property owners are worried about putting their money into their account?

9. We did NOT single out one board member . . . with pictures plastered all over town, identifying her as the cause of all the alleged misdeeds. We DID single her out as the cause ofthe red tags issued by the county. This was the result of her complaining to the county about the travel trailers. This was not a Downeys thing it affected the entire Sargent area. Any of you remember Capt. Clean-Up? He caused some of the same problems and suffered the same consequence!

10. Friends of the plaintiffs . . .circulating a petition to close down the association completely. !!!??? Havent seen one of those. If you have read the by-laws, you know that a petition wont do it and its not likely that 90% of the members would vote to pull any section out anyway. This was not our intention. Where do they come up with this garbage?

11. And, speaking of garbage, the article stated that if the subdivision is shut down, lending institutions will be hesitant, if not outright refuse, to loan money for mortgages in this area because of no deed restrictions. BS! If thats the case, how does anyone else get a mortgage thats not in a HOA? Look at Canal Drive they have no deed restrictions. There are many homes around Sargent, Texas & the entire U.S. not in an association who have mortgages.

12. Did you know that the association was paying for liability insurance to cover OUR liability for accidents and injuries near our property? Me neither. The article claims that if there is no association, the liability insurance will no longer be available, leaving lot owners personally liable for accidents and injuries near their property. Sounds like they are really pushing the scare tactics to win your vote!

13. They claim that the subdivision is only trying to clean up abandoned trailers and recover outstanding maintenance fees. That would be great if thats what they were trying to do. The article neglects to inform you that they:

a. Hit camper trailer owners with fines if they had more than one camper per lot. (Nothing about that in the deed restrictions.)

b. Hit new property owners with up to $1,000 in back maintenance fees, after the owner purchased their property at the tax auction.

c. Demanded that Sargent Garbage Service, Sargent Tire Service & Sargents News close down, as we were in violation of the deed restrictions. Funny, two of these businesses were in existence back in 1996 when the owner was elected to this same board. No one has ever complained about these businesses. Why now? Could a rival newspaper have anything to do with that?

d. Have neglected to send out invoices for maintenance dues to everyone for several years. How do they expect to collect dues if they wont try to work things out with their neighbors?

ITS TIME TO ELECT A NEW BOARD AND YOULL HAVE YOUR CHANCE. ALL PROPERTY OWNERS WILL BE ALLOWED TO VOTE AND/OR RUN FOR THE BOARD, REGARDLESS OF YOUR DUES STANDING

Hello, Everyone -
After a long, quiet spell, we finally have news.
It took us some time to get the affidavits together that were needed, then it took a little while to get into court.
But on Thursday, July 1, Judge Estlinbaum in Bay City signed a temporary restraining order & set a date for the next hearing.
Papers were served requiring the board members to appear at the next hearing: 9 a.m. on Friday, July 9, 2010.
The board was also ordered to immediately restrain from the following:
1. Taking any action to amend the bylaws of DCCCLOA
2. Declaring that any member of DCCCLOA is not in good standing
3. Recording any lien upon the property of any DCCCLOA member
4. Assessing any fines or fees against any DCCCLOA member
5. Asserting any alleged violation of the DCCCLOA deed restrictions of record
6. Taking any action to change the current DCCCLOA deed restrictions of record
7. Calling or holding any meeting except as expressly authorized by the court
8. Taking any action to expel or evict any tenant from the DCCCLOA orrice building
9. Holding any vote except as expressly authorized by the court
10. Taking any action in his or her capacity as office and/or director of DCCCLOA whatsoever, unless specifically authorized by court
11. using, apportioning, expending, selling, giving or transferring in any manner any of the assets of DCCCLOA without the court's authorization, and
12. authorizing or instructing any agent, attorney, assign, successor or other person acting under the control or authority of the Defendants, collectively or individually, to take any action described in (1) through (11) inclusive.
It also ordered that defendants are restrained & expressly prohibited from destruction of any corporate books, records & documents of DCCCLOA.


They locked the office up on Saturday, 7/3, with a note on the door: "Closed because of restraining order filed by Ruth Risinger, Lamar Brown & Mary Ann Dittert". They didn't have to do that, but we think they were afraid some of us would show up & want to see the books & they couldn't kick us out!
Each board member was served individually, along with Roxanne Williams as acting agent for Downey's.
They were all ordered to appear before the judge this Friday, July 9th. Hopefully, at that time, the judge will order the Special Meeting we all requested earlier this year. That will give us the opportunity we need to elect new board members & get our organization back on the right track.


We don't know yet if Friday's court meeting will be open to the public. Hope to find out tomorrow (Tuesday). IF it is open, it would be a good thing to have association members present, just as a show of support. I will let everyone know as soon as I get word.


Keep in mind though - when the Special meeting is ordered & the date is set: WE WILL NEED ALL THE DOWNEY'S MEMBERS THERE THAT WE CAN GET. You've all been very supportive - please hang in just a little longer!


Just because we have the attorney moving - it's still not too late to send in your $$$ to help with the legal fund!
