Actually what I meant to emphasize was the "Fail first" policy of the child in question. It is the official policy that a child must enter the public school as a "regular" student and "fail" in his coursework before he is eligible to be evaluated and have an IEP. Even then, all of that does not guarantee that the school will provide adequate educational help that will enable the child to learn what is needed with the help they require in terms of methods, special "evidence based" type of instruction or equipment. The result is delay in appropriate timely help due to appeals and the slow response of the system.
That was what I was most concerned about.
