A student can have an IEP without being qualified under IDEA. I don't know the prodedure, but that sounds like the "waiting to fail" you mentioned.

A kid can qualify under IDEA at age 3. Once qualified, the IEP is done before anything else. That's the situation in the brief you posted.

This case wouldn't apply to a non-qualified student who has an IEP.
