The decision to promote students who fail the CRCT is strictly a local one. Neither Kathy Cox nor SBOE policy is involved – the appeal procedure was coded into GA law before Cox ran for superintendent.

Her position on LSAs promoting these kids is immaterial since, as a matter of law, she isn’t allowed to interfere with their decision. As I recall, she was on the House Education Committee at the time so she was involved with this legislation, but it was hardly her idea.

The AJC’s statement, “state and local educators are balking at enforcing the 2001 law” is inaccurate. They are actually balking at the notion that any kid should be promoted or retained based on one test score – precisely the notion upon which CPOG and CPOGA were founded. Provided they follow the appeal process correctly, a local school authority can promote every student who fails the CRCT and be in complete legal compliance.

If you want to force her out of office, you need to find a situation where she violated the law, not complied with it.
