Inasmuch as we already agreed this lawsuit is ALL ABOUT MONEY, everybody that's still following it understands its genesis. And I doubt that the Georgia Supremes will view a hypothetical example in a teacher/student sex case as relevant or meaningful precedent in deciding this case currently before it. What is difficult to comprehend, however, is the claim in the Gwinnett BoE's lawsuit, when:

o a Commission Charter School -- for administrative purposes -- is "treated as CONTAINED WITHIN A SINGLE, STATE-WIDE LOCAL EDUCATION AGENCY" (emphasis added)), then,

o how can the same Commission Charter School(s) simultaneously be considered an "independent school system"?

Also, a possible answer to your concern as to why Alvin "is being far too polite about this situation" may be that he doesn't want to p--- off a lot of Gwinnett parents and pro-school choice advocates (voters) in the current populist environment.

For what it's worth, I'm confident that the Georgia Supremes will seriously consider your advice about what they must consider; precedent; the constitutionality or unconstitutionality of various sections of Georgia school law; and the necessity to "flush" any and all sections deemed to be unconstitutional; etc. Nevertheless, I'll wait a couple days to learn exactly how the Georgia Supremes rule.
