Dear New York Dog and Cat Breeders and Pet Store Owners:

Effective July 1, 2002, the New York State Pet Dealers Licensing Law requires the licensing and inspection of pet dealers who sell more than nine dogs or cats per year for profit to the public. If you are affected by this law, you must apply for a license prior to July 1 in order to continue in business.

Some dealers are exempt from this law. You do not need to apply for a license if:

~ You are an incorporated humane society dedicated to the care of unwanted animals which makes animals available for adoption, whether or not you charge a fee for adoption; or

~ You are a breeder who sells, directly to the public, fewer than 25 animals per year that are born and raised on your residential premises.

Please note that, even if you are exempt, you may still voluntarily choose to be licensed and inspected. Just follow the instructions on the license form.

If you are a pet dealer in operation on or before July I, 2002, following the receipt of your . application by the Department you will receive a letter of acknowledgement, and you may continue to operate. Thereafter, an inspection of your facility will take place later in the year to determine compliance with the law. After you pass an inspection, you will receive a New York State Pet Dealer License, which you must display.

Pet dealers who are not already in operation on or before July 1, 2002 may not operate until an inspection has taken place and a license has been issued.
