I'm not sure what time of year you're speaking of, but messing with birds' nests (except starling and house sparrow), active or not, is a federal offense -- I believe it's under the Migratory Bird Act laws. So, you might have a foot to stand on, whether your neighbor knows the warden or not.
For sure, get a photo of them so it's not just your word against theirs.
