Subject: Insurance settlement

You may remember that I was in a rear ender car accident
about 2 1/2 years ago. The settlement is now pending.
There was $42,000 in medical expenses. Her insurance is
paying the $25,000 limit of liability. My insurance,
State Farm, is paying $3,000 of the $50,000 liability
I pay for under uninsured/under-insured motorist. Of
the $28,000 pay out, about $8,800 is being paid on yet
unpaid medical bills. State Farm did write off about
$5,000 in medical expenses paid. About 2/3 of the amount
of the settlement goes to attorney fees and expenses.
My attorney told me that if I had more coverage for
uninsured motorist, I would have got a better settlement.
Medicare, who paid for most all medical expenses gets no
reimbursement. Her insurance was totally unresponsive
early on and everyone billed Medicare. Even though everyone
knew it was treatment from a car accident, they billed
Medicare. Medicare, even though her insurance was listed
as MY secondary insurer, said they had no claim to the
settlement and lost out on thousands in reimbursement.
State Farm used that as their "proof" that not all my
medical expenses were a result of the accident.

And so it goes....
