GMA Network files P100M libel suit against ABS-CBN officials, news anchor and reporter

GMA Network has filed a P100M libel complaint against ABS-CBN Broadcasting Corporation Chairman and CEO Eugenio Lopez III, President and COO Luis Alejandro, news anchor Erwin Tulfo, reporter Lynda Jumilla and nine other officers before the Quezon City Assistant Prosecutor’s Office last Tuesday (July 27) after ABS-CBN “blatantly and repeatedly” accused GMA of stealing footage on the arrival of Angelo de la Cruz last July 22 in its news programs.

GMA Network Chairman, President and CEO Felipe Gozon, EVP and COO Gilberto Duavit, Jr., VP for News and Public Affairs Marissa Flores, News Director Jessica Soho, News Operations Head Grace dela Peña-Reyes, and News Program Manager John Oliver Manalastas personally filed the complaint against Lopez, Alejandro, Tulfo, Jumilla, and ABS-CBN officers including SVP for News and Current Affairs Jose Ramon Olivares, VP for News Operations Jesus Maderazo, VP for News Productions Luisita Cruz-Valdes, AVP for News Operations Jose Magsaysay, Jr., Director for News Operations Alfonso Marquez, INSIDER Executive Producer Beth Frondoso, Magandang Umaga Bayan Supervising Producer Maria Progena Estonilo Reyes, Magandang Umaga Bayan Executive Producer Annie Eugenio, and News Patrol Executive Producer Dondi Garcia.

The complaint stemmed from the statements of Tulfo and Jumilla against GMA Network made in ABS-CBN’s news program Insider last July 22 and morning current affairs program Magandang Umaga Bayan last July 23.

INSIDER news anchor Erwin Tulfo and reporter Lynda Jumilla called GMA Network Inc. a thief during their program last July 22. The same remarks were made by Tulfo and Jumilla in Magandang Umaga Bayan the following day.

In the said INSIDER episode, ABS-CBN showed on live video bold graphics that read, “Ang pagnanakaw ba’y serbisyong totoo?” In the same program, ABS-CBN likewise showed the slug, “Exclusive video ng ABS-CBN ninakaw ng GMA-7.”

Tulfo read the news in INSIDER, part of which was the statement, “Kaya nakakalungkot po na may ibang istasyon na nagnakaw ng aming ekslusibong kuha.” He also said at the end of the report, “Okay lang ho sana ang pagsisinungaling pero ang pagnanakaw ay isang malaking krimen.”
In the same news program, reporter Lynda Jumilla stated in her news report, “Ang mga ekslusibong video na kuha ng ABS-CBN news lumalabas din sa GMA-7. Mula paglabas ni dela Cruz sa eroplano, pagdaan sa tube, hanggang sa pagpasok sa VIP lounge. Pati mga eksena sa press conference, kinuha din mula sa video ng ABS-CBN.” Jumilla added, “Pinag-iisipan ng ABS-CBN na sampahan ng kaso ang GMA-7 dahil sa pagnanakaw ng video.”
Tulfo also made the same derogatory remarks in Magandang Umaga Bayan the following day while Lynda Jumilla’s report was also aired in the same program.

GMA Chairman, President and CEO Felipe Gozon said that ABS-CBN’s malicious statements gave GMA no other recourse but to file the complaint. “Kahit sino siguro ay hindi magugustuhan kung tatawagin na magnanakaw, lalo na kung hindi totoo. So we decided to file a case para lumabas na ang lahat ng katotohanan,” Gozon said. (30).
