Harm was grasping at straws to appeal to the jury. Because of Buxton's zealousness for some action, he failed to take the steps necessary to avoid making a deadly mistake. Safeguards are there for a reason. Imagine being killed because you looked close enough to a suspect because you were the same height and had the same hair color. What Harm's argument did was put the whole thing in a context of what if rather than what it was. Buxton would not have been prosecuted for failing to act if he followed the protocol that was set up to safeguard mishaps like these. Buxton's close enough comment was enough for me not to give him the benefit of the doubt that his motives were altruistic.
