Our Hon. Secretary, today, Wednesday, has contacted various politicians, clergy and such groups as the N. I. Human Rights Commission after being alerted that the last serving republican prisoner in an English jail, Noel Maguire, is again being threatened by right-wing inmates at HMP Full Sutton. This memo reflects solely our humanitarian concern and does not reflect any particular political bias, as our concern for all prisoners has been part and parcel of our many wide-ranging endeavours for more than a decade.

Mr. Maguire, from Co Fermanagh, holds a valid Irish passport. He is serving a 20 year sentence. His most recent application for repatriation has been turned down. That was his third application. Dublin’s official refusal flies in the face of such facts that he is a long-suffering target of acute harassment, and fell victim to a serious knife attack which required him to be hospitalised.

We believe - as he does - that another attack on him is more than likely, which could prove to be fatal. We are incredulous that the Irish Ministry of Justice has decided to ignore the dangers he faces on a daily basis, in spite of prolonged representations, from at home and abroad, many from concerned high-profile individuals and groups.

He meets all the criteria laid down by Euro legislation on the transfer of prisoners, yet the former Minister of Justice, Michael McDowell continued to falsely insist that Noel’s family links were stronger in England, and that he had no family whatsoever in Ireland. The reality is that he has no relatives at all in England, but has many in Ireland, both north and south. We are in contact with family members in Fermanagh, and his wife who lives within an hour’s journey of Portlaoise prison, to where he wishes to be transferred. We had hoped that the new Minister, Brian Lenihan, with whom we and his family, and others have been in contact in recent times, would have taken a more sympathetic stance on Noel’s plight. We know that in recent days detailed documents where passed on to Mr. Lenihan, at his own request, through a go-between, who is a close friend of his within Fianna Fail. As yet there has been no response in spite of the gravity of the situation in HMP Full Sutton.

We hereby implore all concerned to highlight this case. Could it be that Noel only returns to Ireland in a coffin? If so then the Dublin authorities, who have dragged their heels on repatriation for so long, can hardly claim that they were not alerted to the life-threatening dangers facing him, as the files of various concerned individuals and groupings, as well as members of the print media, can clearly illustrate. Ironically, the British authorities are blameless in this instance.
