Subject: Hmmm...how does it feel when one's liver hurts :-)? What do you think will happen with Jamie & Claire? Also, I am curios if anyone knows marriage law of the time. Does Claire have to formally divorce John now that her husband is not dead-or is her marriage to John null and void since Jame is not dead? I know now that you have to declare someone legally dead before you can do anything. But I am curious as to what it was back then.
In reply to: Lady Oliver 's message, "DG mentioned that maybe it wasn't a punch that injured his liver, but perhaps he got injured while trying to avoid a punch. I don't know if she's serious or just trying to throw us off. In Echo Jamie just asks "why?" It sounds like LJ's answer/excuse wasn't good enough for Jamie, no matter what happened to injure LJ's liver." on 14:16:35 03/07/10 Sun

[> [> [> [> [> [> Well, J&C marriage was registered in Scotland, as well as Jamie's and Laoghaire's, probably they didn't request proof of 'unmarried' status prior to marrying. I don't know if there was any record of it J&C marriage in America, so maybe C&J just went ahead and did it. Maybe they could just get it annulled...with no settlement, bar the satisfaction that Jamie is going to help himself to at John's cost. -- Ayira from Panama, 10:53:18 03/09/10 Tue

[> [> [> [> [> [> [> I think it was a lot easier to get married in those days when people were more bound by religious laws, I don't think you had to register your marriage with the government like now. When they asked if there is any impediment to the marriage, if you believed your spouse dead that was good enough. Plus you had to call 'bans' giving anyone 3 weeks to object - bans could be excused in some circumstances (like you're nobility and rich *G*). It was pretty common for women to have their sailor/soldier dh missing for years and remarry believing him dead, not so common for him to return. -- jayn, 15:18:24 03/09/10 Tue

[> [> [> [> [> [> [> [> So what happens when said "dead" husand re-appears? It does not seem as though a great deal of time has passed since Jamie is believed dead and then appears (seems like only a few months at most). Certainly not years...if it is years then I totally have that timeline screwed up :-). -- Rollaine, 23:14:28 03/09/10 Tue

[> [> [> [> [> [> [> [> [> No, you're right about the timeline, I only meant folk usually waited a number of years, I suppose there was an expectation of how long each trip should take and things went from there. I imagine re-marriages didn't normally happen so quickly (unless of course the bride is a rebel spy needing rescueing by the lord and friend *G*). I don't imagine the hubbys usually did return, but I think the 2nd marriage would be annulled. It seemed simple enough with Laoghaire, (in terms of the fact of annullment, not the dramatics of the story) -- jayn, 13:19:41 03/10/10 Wed

[> [> [> [> [> [> [> [> [> [> So, however this is resolved, you think, given the short period of time that Claire's marriage to John would be annulled since Jamie is not dead and they would still be legally married? Geez, this could make my head hurt. With Loaghaire it was different becasue it was 20 years later that Claire comes back. Curious if time is a factor. My husband is a lawyer-I wonder if he knows the laws of the time. I never know what info is swimming around in his head, but he knows alot! -- Rollaine, 13:48:07 03/10/10 Wed
