Subject: Tough on Crime???

How are defense attorneys are tough on crime? Isn't the job of a defense attorney to get their clients off?

Daniel, In response to your post direct your attention to the Bill of Rights of the Untied States Constitution, which guarantees that the accused shall enjoy the right of a fair trial. Therefore the job of the Defense Attorney is to make sure that the accused is afforded that right and that the State proves the case beyond a reasonable doubt (not to get people who murder off as you are implying).

Before ever posting on this site again on this topic you should review the elementary documents of our Forefathers. I hope for your sake that you are never falsely accused of a crime and are in need of a defense attorney (hopefully Mr. Collins will be available to represent you by then).

It is the job of any attorney to represent their client as best as possible. This is also true of criminal defense attorneys. Failing to do so is grounds for disbarment.

As the State's attorney I will institute a comprehensive plan to attack crime. The program is similar to the one I instituted while the Commander of the D.C. Police Homicide Branch. The plan resulted in our arresting and successfully prosecuting more murderers than at any other time in the history of the city. Our enforcement component was accompanied by a crime prevention component. Both were successful as we were able to reduce the murder rate by over 20% at a time the murder rate was rising nationally and at a time the city was near bankruptcy.

I expect comparable results here in Charles County.

Your proactive plan for arresting and prosecuting "more criminals" is a classic expample of you being soooooooo much a fence stander..Perhaps you should take a job with CPS or one of the other State Entities that can hide behind their amiguity.....

This also includes the attorneys representing the state and their obligation to the state as well as the victim that they are personally responsible for prosecuting for....!

The Bill of Rights of the Untied States Constitution, which guarantees that the accused shall enjoy the right of a fair and expediated trial is biased. 3 years worth of delays and continuances with the defense is acceptable as standard...but a single delay from the prosecution is considered an atrocity and should be considered a violation of the perps rights.....!

It is interesting that the U.S. Bill of Rights only addresses the Perpetrator...? When does the victim enjoy the freedom of a fair trial....? NEVER in our system...and that is more than criminal....!

Therefore the job of the Defense Attorney is to make sure that the accused is afforded that right and that the State proves the case beyond a reasonable doubt AND that there is equal justice under the law for even our most vulnerable victims...our babies

If you don't care for our Constitution I suggest you try to change it or leave the Country. The type of criminal justice system you crave for is available (Cuba, Iraq, Iran) and I doubt you believe it would be an improvement over ours.

This may come as a surprise to you but I did not write our constitution or the bill or rights. However, I believe strongly in our criminal justice system. If I have a problem with it I attempt to make changes to improve it. Complaining alone gets us nowhere.

With respect to my philosophy on addressing crime, I do believe in vigorous enforcement coupled with a prevention component. If I can prevent someone from committing a criminal offense where someone is seriously injured, that is far better than arresting the perpetrator afterward and the victim still suffers. If that is fence sitting I suggest you check out my record as Commander of the D.C. Police Homicide Branch. We implemented a similar program there which resulted in our arresting and sucessfully prosecuting more people for murder than at any time in history. At the same time we were able to reduce the murder rate by 20%. It works!
