Subject: USFSPA goes to court

The validity of the USFSPA has been debated for years and there are strong opinions on both sides of the arguement. The retirees claim they have no property rights to their own retainer pay and should not be considered a divisible community property when divorce happens. The former spouse claims that he/she earned the right to half of the retirees' retainer pay due to the hardships placed on military families. Go to any pro- or anti- USFSPA website and you can feel the heat coming off of your screen.

While both sides have their opinions, soon it may not matter what is said. A growing group of retirees, with the help of attorneys, are lining up to take the issue to court by declaring the law is unconstitutional.
