When a Republican has sexual relations with his secretary or has an inappropiate relationship; this is deemed as "sexual harrassment"?

When Congressman Patrick Kennedy (D)-Rhode Island literary threw a black female security guard up against metal railing at Los Angeles International Airport a few years ago, this is NOT deemed as "sexual harrassment"? Not even Assult and Battery or a misdemeanor come to think of it?

Is it the case of money, family and influence "talks" while all others just simply walk and pay the legal price?
