Now, now. Marty did in fact email me with asking for the permission for this territory. I never got around to emailing her back, but I was going to say yes. So any fact that whether she is lying about the email, the territory is hers.

The main purpose of a back-up is when the leader is abscence for whatever reason, the back-up would take over. But a back-up is only temporary. If you wanted the territory, since Rebel Spirit has been inactive for quite a while, you could have emailed Kate or I.
