物料歸僱主所有。
(V) 依本節 (a) 段進行遷離的合理費用。

28 轉讓
i. 僱主未得承建商的同意不能將本合同轉讓他人。
ii.承建商未得僱主的同意不能將本合同轉讓他人。

29. 分包
i 除非僱主特別許可 , 承建商不能將本工程分包。僱主有絕對權力不批准分包。雖然僱
主可能未有阻止分包 , 僱主仍有權擠棄任何分包人 , 並有絕對權力要求任何分包人脫
離本工程。
1 1 本工程全部或部份的分包不能減輕承建商的承擔或責任 , 承建商仍須對分包人及其僱
員或代理人的任何行動、錯誤或疏忽、當作是自己做成的需負全責。
.iii .承建商有責任在項目經理要求時 , 把僱用或將會僱用的任何分包人的資料交給項目經
理。
iv. 在任何分包合同中 , 須有一條款 , 註明分包人按分包合同的僱用 , 在承建商按本合同的僱用終止時 ( 不論任何原因 ) , 亦同時一齊終止。

30. 其他施工單位
承建商須准許僱主直接聘用之其他施工單位進行本合同以外的其他工程。此等單位在第
15 條款下視為僱主須負責之人士而非分包人。

31. 中期付款
1. a 除雙方在付款方式中另有協議外 , 承建商應按附錄內註明時間 , 提交中期付款申請。
b 中期付款申請 , 應連同僱主要求的詳細資料 , 根據項目經理提出之格式 , 一同呈交。
c. 項目經理須對付款申請加以審核並發出中期付款通知書予承建商 , 說明核實應付的估算金額。
d. 在承建商呈交中期付款通知書後 , 僱主根據在附錄內所列的付款寬限期按中期付款
通知書內所述之金額支付承建商。
e. 若收到任何中期付款申請通知書後 , 僱主認為中期付款通知書內所述之金額有不符
合本合同之規定時 , 僱主可根據本身確算認為合理之中期付款金額 , 支付予承建商。
f. 有關本條款 (i)(e) 節所述有關僱主支付與承建商的中期付款金額 , 不會影響承建商
本身認為僱主無理扣押任何金額 , 或本身認為不依本合同規定支付款項所擁有的權
利。
11 中期付款申請中所示金額 , 是承建商在每月已完成的工程及運到現場或鄰近之物料總
值 , 減去保修金後之估值 ( 按本條款第 ( i i i ) 節之規定 ) 。中期付款申請內所包括的物
料 , 須在合理地、正確地和非過早地送到或安放現場上或鄰近 , 並對天氣及其他事故
