7.Cowboys Builders Ltd is a small building firm. Brian, a Land and Construction student, at Greenwhich College called in at their offices to ask them if they could replace some tiles that had fallen off his roof. On the wall of the office is a sign in large letters stating:
STANDARD TERM N6. We cannot accept any liability for damage caused to you, your property, or goods, as a result of building or repair work carried out by this firm.
As the price quoted to him was very low Brian decided to engage Cowboys Ltd. He signed a contract for £200 which stated that he would be bound by Cowboys' standard terms and conditions.
On the agreed date Cowboys turned up to start the work. However while Alf, one of their workers was on the roof, he dropped a large metal tool that fell though the upstairs window of Brian's flat smashing the window and damaging Brian's computer.
Advise Brian whether:
a)The exclusion clause is part of the contract?(10marks)
b)The exclusion clause covers the above damage?(5marks)
c)In what way is the exclusion clause affected by the Unfair Contracts Terms Act1977 and the Unfair Terms in Consumer Contracts Regulations 1994?(10 marks)
