I’ve been trying to refrain from using this site as a debate forum, but its come up again. I find the multi-million dollar pain and suffering settlements appalling. Yes, it sucks to have something go wrong. Yes, it can happen to anyone. But life ain’t perfect and no matter how rich people or their descendents become for having something bad happen to them, that doesn’t make them better and it doesn’t even have a direct impact on the person/system that made the mistake. It impacts the doctor/hospital malpractice insurance companies first. They in turn raise the malpractice premiums for all healthcare providers and the doctors/hospitals raise their fees to offset the premium spike. This, in turn, causes health insurance companies/government entities to raise their premiums to cover these increased fees, which in time is passed directly on to all of us. So, we're the ones paying these settlements.

Curbing the absurdly high settlements won’t solve the escalating costs of healthcare, but they will reduce one of the causes of cost increases. (Disclaimer: I am married to a doctor, I am a patient for other doctors, I work for managed care companies and I pay healthcare premiums.)
