is pobably treated "like" new. The mileage count on the engine is apart from the car. If you look at for sale ads: " 1996 BMW 540, 46K mi8les, rebuild engine only 7K miles" is considered to be reasonable and acceptable. I don't think you can win there after you've acepted the engine. Unless you have something in writing that says "brand new, never fired", the courts will probably side with customs of the industry.
