The best thing you can do right now is send in the form for intent to sue under lemon laws. Get that out of the way now so you won't have to wait to allow for their "final chance to fix it" if they won't do anything.

I've had good luck with just using the notification of intent. My car was collecting dust in the dealer parking for over 30 days waiting for a new differential. The parts were nowhere in sight until I sent my notification of intent to sue under lemon laws to BMWNA. Magically 2 days after they received my letter the differential appeared at the dealership and they stayed open late on Sat to finish installing it. >;-)

I would suspect you have a good shot of getting an easy settlement (maybe a buyback, replacement car or a new engine) by just sending in your notification to BMWNA.
