and Ford/Firestone ignored it. There is the foreseeability. There has been no injury here although we will argue the probability. I am not sure but if I were defending BMW on such a suit I would say we have no data to show that this is consistent in a significant number. Maybe that is why BMW is silent abou this. If they acknowledge, they admit foreseeability, which there is no concrete evidence of right now.

Unless all the M3 owners band together, am not sure the numbers will be enough. There are too many people that just don't want to stir up the hornet's nest. In terms of the breach of contract, the warranty probably covers that. anywya, for every point, there is a counter point. Just need a good attorney that is experienced in this stuff. Anyone know who litigated the Ford/Firestone case? Before running around trying to find an attoryney, why not contact the ones that are experienced in high profile cases?
