My M3 engine spun a rod bearing at 10k and was replace by a "remanufactured" engine. The warranty on the engine is now 100k miles (actually 90k because it's based on the odometer, not the engine life), which is much longer than the original engine warranty. Although there are resale issues, what damages can you PROVE in court when BMW has given you more than what you had before the problem. I'm not wasting my money on lawyers....I'm driving my M3 every mile of that 100k and holding them to their warranty. PS In order to prove damages you'll have to prove that your car is worth less money than before the problem against BMW's expected claim that you now have more than you had before.
