First, let me say that that sucks. We should all be able to rave about how smooth and powerful and reliable this engine is, because it CAN be all those things. My 11/01 prod engine is quite smooth from idle to redline, so yours is less than optimum. Take it back to another dealer, maybe.

Peter on this board also has an RMF engine, which seemed to pull stronger than my original engine (BTW, my engine seems down on power, see my dyno here). StoneWalk on Roadfly is receiving an RMF engine right now. He feels it should be fine, and believes they are assembled alongside the new engines at the same facility in Germany. Plus, he pointed out a few small benefits to having a seasoned engine block.

Regardless, it is not right for BMW to say 'NEW' and give you RMF. Probably illegal, certainly unethical.
