Is the USA Patriot Act Constitutional?
At 18 years of age I am now being faced with “real-world” problems and realities. My Helena High School’s American Government class has really helped bring these issues to a level of our understanding. Our teacher has assigned us to pick an issue of importance on the local, national or global level. I have chosen the issue of national security, namely the Patriot Act, recently passed by congress in the wake of September 11, 2001. Every two to three weeks we are to give a report to the class on how the issue is going. In my report I hope to bring in local feed back regarding the Patriot Act so I can demonstrate how this national issue affects our community. Every law and act has those who support and those who oppose the ideals that are represented in the legislation. The Patriot Act is no different. The intentions of the act are to increase homeland security. In doing so the government feels that they will/should be able to stop another terrorist attack before it even starts. However, some feel that the government way of stopping the terrorist attacks are infringing on our basic civil liberties and rights given to us under the constitution. Under the Patriot Act, the government is at liberty to conduct “sneak and peek” procedures, wire tapings, eaves dropping, as well as detaining one indefinitely under suspicion with out telling the person of their crime, taking away the right to due process. On the other hand, the feelings are if you have nothing to hide why do you care, or in believing the government has to do what it has to do to keep our country safe. So my questions are, do you feel that our government was right or wrong for passing the Patriot Act?
