Whoa, definitely off topic. Sorry for posting this in the first place - as it was an aside joke.

Quick fact #1: a trademark is a word, number, symbol, etc. or combination thereof, of a product or service, and functions as an indicator of source in the marketplace.

Long story short – it makes sure that product XYZ is actually made from company ABC.

Quick fact #2: As a person you can’t just trademark your name because. You can only trademark a word (in this case it can happen to be a person’s name) if it represents a product or service.

So to answer your question – the person isn’t registered; his product name may or may not be.

TM – for unregistered or pending terms
® - for terms registered within the country’s Patent and Trademark Office
