Sydney smart card lawsuit dismissed Electronics News

Court proceedings brought against the NSW Department of Transport and the government over their handling of the Sydney Integrated Ticketing project tender have been dismissed.

In a judgement handed down this morning, the Supreme Court of NSW dismissed proceedings by US-based transit smart card developer Cubic Transportation Systems and awarded court costs against Cubic.

Cubic had initially obtained an injunction preventing the government from signing the $100 million contract with preferred tenderers ERG and Motorola.

Contractual negotiations between the Department and the winning consortium had continued despite the impending judgement.

Under the deal, the winning consortium will provide a contactless smart card system stretching all modes of public transport in Sydney and the surrounding region.

Final terms of the agreement were initially expected to be complete by December 31, but the initial injunction may have delayed that outcome.

When the system is completed in 2005, commuters will only need to pass through a validator in the entry/exit area of the station to have their ‘ticket’ authenticated.

ERG has issued a statement that the company will review the reasons for judgement as soon as they are made available.

The Supreme Court will hand down its reasons for the judgement this afternoon.26 July 2002
