Subject: Washington State Bills

ATTENTION !

On Thursday February 27, 2003 at 1:30 WAF and State Representative Campbell testified in front of a Senate Committee on the sister Bill to HB 1895, SB 5950. There was only one representative for the insurance companies who testifed in oppostion of the Bill. KIRO TV News was there and interviewed Representative Campbell who showed them pictures of his Rottweilers and then interviewed WAF Consultant Glen Bui who's American Pit Bull Terrier UKC CH Pantara's Zeus was discriminated against over insurance, they filmed the dog at the state Capitol on the Campus grounds. They aired the story three times throughout the night, it was great PR for the breed and to help gain support for both HB2043/HB1895!!!! Keep the support rolling in, we know owners of all different breeds are flooding the committee's. Below is the information on the bills, please forward these e-mails.

ATTENTION! Both bills, HB1895/2043 have been given public hearings. HB 2043 which prohibits using the breed of a dog to determine it potentially dangerous/dangerous and defines provocation will be heard at 8:00 pm March 3, 2003 Monday evening in the John O'Brien Building by the Judiciary Committee in Hearing Room B at the Washington State Capitol. We ask everyone who owns a dog no matter what breed to attend the hearing to give support on HB2043.

Monday March 3, 2003. If you own any breed of dog this Bill protects your rights as responsible dog owners. We ask everyone to support HB2043.


HB 1895 will be heard on March 4, 2003 at 10:00 am in the John O'Brien Building in Hearing Room C. We ask everyone in Washinton State who owns a dog to attend this hearing, it will help put a stop to discrimination by insurance companies. We will post the members e-mail to the Committee hearing HB1895 in our next post, or to obtain them you can go on line to WA legislature and click on House of Representatives, then go to Committee's and click on Financial Institutions and Insurance Committee.

Two Bills have been introduced in Washington, HB 1895/HB2043

HB2043 was drafted by WAF and Seattle Attorney Jim Anable a member of D.O.G. an organization formed to revise the Seattle Dangerous Dog Law. This bill is to prevent breed as a determining factor in declaring a dog potentially dangerous/dangerous and it defines provocation. We expect several amendments in the upcoming legislative sessions to improve Washington States Dangerous Dog Law RCW16.08.70/100.

HB 1895 was presented for sponsor by Tacoma Attorney Jeffery Helsden and it prohibits insurance companies from denying insurance based on breed !!!

WAF spoke with the sponsor of HB1895 on 2/21/03, he told us AKC is supporting the bill and clubs and dog owners from other parts of the U.S. are supporting it. No support has come in from Washington dog owners!!!

The deadline for hearings is March 5, 2003. If you live in Washington and own a dog, you need to support these Bills. You need to attend the public hearings, we will give 24 hour notice. On HB1895 we need everyone to e-mail the Chair of the Financial Institutions and Insurance Committee and ask her to set HB1895 for a hearing. AN ACT Relating to homeowner's insurance; and adding a new section to
chapter 48.18 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

{+ NEW SECTION. +} Sec. 1. A new section is added to chapter 48.18 RCW to read as follows:
An insurer licensed to write liability insurance, such as homeowner's insurance, in this state may not deny an application for a homeowner's insurance policy, or cancel, refuse to renew, or modify an existing homeowner's insurance policy, on the basis that the applicant or insured owns or harbors a specific breed of dog on the real property, unless the dog is a dangerous dog as defined
in RCW 16.08.070.

AN ACT Relating to dangerous or potentially dangerous dogs; and adding a
new section to chapter 16.08 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

{+ NEW SECTION. +} Sec. 1. A new section is added to chapter 16.08 RCW
to read as follows:

1) The breed of a dog shall not be a determining factor when declaring a
dog potentially dangerous or dangerous.

2) A dog may not be considered potentially dangerous or dangerous if the
dog's threatening behavior or infliction of injury or damage was sustained by a person who, at the time, was:

(a) Committing a willful trespass or other tort upon the premises occupied by the owner of the dog;

(b) Tormenting, abusing, or assaulting the dog or has, in the past, been
observed or reported to have tormented, abused, or assaulted the dog; or
(c) Committing or attempting to commit a crime.
