then they can't do anything. And they shouldn't. If they incarcerate this guy, what's to stop them from incarcerating me when I tell my coworker "My kids are driving me nuts. I just wanna duct tape their mouths shut and lock them in a closet."

Like in the movie Minority Report ... its just wrong to imprison someone because they *are going to*, or *might* commit a crime. Instead, you use other means of making sure that crime doesn't happen. Like what you said ...taking away his motive and means to commit the crime.

If the kid is mentally unstable, then he should by all means get psychological help ... and if that means commitment to a facility, then fine. But do it because he's sick ... not because he might commit a crime.

And, if he makes specific threats to specific children, BAM. You have stalker laws for that. And I do think the police should keep an eye out for him, etc.
